Buffalo Child Custody Attorney Explains How Medical Bills are Handled

Buffalo Child Custody AttorneyI often have parents come to me as an experienced Buffalo Child Custody Attorney, and they ask how non-reimbursed medical bills should be handled.  Expenses that are not covered by insurance are called non-reimbursed medical expenses. Those normally include co-pays for doctor visits and prescriptions. In New York State, the law says those expenses are to be divided on a pro rata or percentage basis based on the parents’ income. For instance, if one parent makes $60,000 and the other parent makes $30,000 (in other words, one parent makes twice as much as the other), those costs are divided based on a 2 to 1 ratio. It’s always based on the ratio of the parents’ incomes. If the parents are making the same amount, the pro rata distribution would be 50/50. If it’s not equal, it’s based on the respective incomes of the Mom and Dad.
