Penalties for Issuing a Bad Check

  • Knowingly issuing a bad check is a Class B misdemeanor.
  • You are guilty if the check is presented when you know you do not have sufficient funds in your account.
  • A check is presumed to be bad if it is cashed within 30 days of being written or if the writer does not have an account with the bank.
  • This is a very serious offense.
