How does a warning sign affect a slip and fall claim?
Answer:
If you’ve been involved in a slip and fall case and somebody has a warning sign, such as a wet floor sign, that’s a defense that the insurance company can use to say you were warned of the slippery condition and did not pay attention. That does not, however, relieve them of their responsibility to make sure that the floor was safe in the first place. Very often, warning signs are one thing they can do, but very often we will develop a theory where we say they didn’t properly maintain the premises. In other words, there was something wrong with the floor, or they didn’t rope off or barrier in such a way that you wouldn’t go in that defective or unsafe area.
While it is a partial defense for the insurance company to then raise that they did put out some sort of warning sign, it’s not a bar to recovery. It’s one of the factors that goes into the evaluation of your claim. We have experience over 40 years in evaluating these exact types of claims.
