What are common mistakes people make if they have been injured in a pedestrian accident?
Answer:
If you’re a pedestrian and struck by a car, normally what happens is you’re pretty seriously injured because you are not protected. One of the things that happens very often is you are rushed to the hospital. You could be Mercy Flighted. You could be taken by ambulance. You could be taken by another driver who you’ve called. Very often, though, you are getting immediate medical treatment.
A mistake that we see people make is not following through in their treatment. They get their initial treatment, start feeling a little bit better after a few days or weeks, and then don’t follow through. They don’t go back to their own doctor, don’t get that x-ray, or don’t go to a recommended specialist to properly evaluate their injuries. That’s mistake number one, people not following through in their treatment.
The second mistake we see is people don’t call us soon enough. They come in to see us eventually, but they’ve waited too long. If you come into see us right away, one of the things we’ll do is get all the information. Then we’ll send out our investigator immediately. The reason we do that is we want to preserve evidence that’s important to you and your case. You want to make sure that you get photographs of the scene of the accident. Even if you took out your cellphone and took pictures immediately at the scene of the accident, you still want to get it professionally photographed. Another thing you want to do is send out your investigators to get statements from people that witnessed what happened. A lot of times people disappear or their memories fade. You want to send out an investigator to make sure that the evidence that you need to successfully prosecute your claim is preserved.
The two mistakes we see are people not getting follow-up medical attention after their initial treatment and, number two, not coming to see us in time so that we can preserve that evidence.
