        Can I file a claim If I was partially at fault for the bicycle accident?

        People come in that have been involved in a serious bicycle accident, and tell us, “I was riding my bike, and the other driver did this, but I may be partly at fault as well. Do I still have a case?” In New York, we have what’s called comparative fault. In other words, you look at the whole case and see how much the other driver is at fault and how much you’re at fault.

        Very often, in bicycle cases like this, you have a very serious claim. Oftentimes, the driver is at fault, but you, too, are partially at fault. What happens is we look at the overall case, and we determine what the value of that overall case is. Then, we look at that overall value and ask how responsible each person involved is. That’s where our focus and experience come in.

        Simply because you are at fault, does not mean that you do not have a case. You absolutely do have a case, but you need to talk to an experienced lawyer who can explain to you that simply because you may bear some responsibility, that does not mean that you don’t have a case and cannot pursue a claim against the other driver.
