        Can a pedestrian be partially at fault in Buffalo?

        Answer:

        A lot of times, someone who is struck by a car is seriously injured. That person will come in to see us and they’ll say, “This other driver was going a little too fast, but I wasn’t paying as close attention as I should have been.” In other words, they were partly at fault, too. What we explain in a situation like that is in New York, we have what’s called comparative fault. You don’t have to be fault-free in order to have a successful claim for an injury if you’re a pedestrian. Under comparative fault, you’re entitled to a recovery even if you are mostly at fault.

        You don’t have to be fault-free, but what you do need is an experienced attorney who can evaluate and fairly and honestly tell you how being partially at fault affects your claim. It doesn’t mean that your claim goes away. It doesn’t mean that you can’t get a recovery. What it does mean is that your claim may not be worth as much, due to the fact that you are partly at fault. You need someone to be able to explain that to you, what the laws are in New York, and how that affects your total recovery.
