        What happens if a poorly maintained road caused my injuries?

        Answer:

        If you’re in a motorcycle crash and the crash is not caused by another vehicle but by poor highway or road conditions such as potholes, you absolutely have a claim against whatever municipality is responsible for that road. In these situations, it’s very important to contact us, or any lawyer, as soon as you can. There are very short deadlines that have to be met when notifying that municipality.

        The first thing you have to do is find out who owns the road. Is it the village? Is it the town? Is it the city? Is it the county? Is the state? You have to find out who owns the road. Once you find out who owns the road, then you have to give that municipality, whether it be the town or the city, proper written notice. If you don’t do that within 90 days, you are then going to be out of luck. Even if you’ve been seriously injured, and it’s not your fault, if you don’t notify that municipality, that town, that village, that city, within that very short time frame, you are going to be, unfortunately, unable to bring a claim. You do have a claim if you’re injured because the road is in poor condition, but there are things that you have to do very quickly in order to preserve your legal rights.
