        Who can bring a wrongful death claim forward in Buffalo State?

        Answer:

        Normally you’ll look at two classes of people for people that are entitled to bring a wrongful death claim in New York state. One would be the executor of an estate. If the person that died had a will, that person’s executor could then file a wrongful death claim on behalf of the person that died. The second person that could do that, if the person had no will, is the administrator. The administrator is someone not named in a will, because the person didn’t have a will, and that person has to be what is called a distributee. In other words, they have to be entitled to receive some of the money that a successful claim would bring.

        Those are the people that can file the claim for a wrongful death on behalf of the family, either the executor of the state or an administrator who is also a distributee in the state of New York. As a distributee, that means somebody who would be entitled to receive some of the proceeds from a wrongful death claim.
