        Can I sue my employer in Buffalo?

        Generally, in New York state, you’re not allowed to sue your employer. That’s covered under workers’ compensation. That doesn’t mean that you don’t have a claim, however. Generally, with construction site accident cases, what you’re looking to do is put everybody on notice because these are the people against whom you’ll have potential claims. It could be the owner of the site or the general contractor of the construction site. It could be different subs, too— either the roofing sub, carpentry sub, or the plumbing sub. You need to put everybody and anybody on notice with respect to a potential claim.

        In terms of a direct lawsuit against your employer in New York state, that’s covered by workman’s compensation, and you would not be able to directly sue your employer.
