Assault in the First Degree

New York Assault Charges Buffalo Criminal Defense Lawyer AttorneyAs a Buffalo attorney, I am often asked about the charge of assault in the first degree, which is a Class B felony. You are guilty of assault in the first degree if, in the commission of another felony – or in flight from one – you cause serious physical injury to another person, including either death or impairment of a body function. If you are charged, it is important that you speak with a Buffalo criminal defense attorney as soon as possible.

Assault in the Second Degree

As a Buffalo criminal defense attorney, I am often asked about assault in the second degree, which is a Class D felony. You are guilty of assault in the second degree if, in the course of committing another felony – or in flight therefrom – you cause physical injury to another person which includes severe pain or impairment. A number of factors are considered in determining whether or not you were in flight from committing a felony. Those factors include the distance from the site where the felony occurred, whether you are in possession of the fruits of the crime, and whether a police officer or peace officer is involved. This is a very serious offense for which you should contact a criminal defense attorney as soon as possible.

Assault in the Third Degree

As a Buffalo criminal defense attorney, I am often asked about assault in the third degree, which is a Class A misdemeanor. You are guilty of assault in the third degree if you cause physical injury to someone, including severe pain or substantial impairment. If you are charged with assault in the third degree, you should immediately contact a Buffalo criminal defense attorney.
