Clients often ask me what they can do about a relative with dementia who is a danger to themselves or unable to maintain their financial affairs. The only solution is usually to have what’s known as a Mental Hygiene Article 81 guardian appointed for them. As an incapacitated person, the guardian can take control of either their person and/or their property after a proceeding in Supreme or County Court.
