The Surrogate’s Court hears cases relating to individuals who have passed away, including disagreements about wills and the proper way to manage or divide the estate (total assets and liabilities). Surrogate’s courts are also authorized to handle adoptions.

New resource for requesting a Waiver of Citation and Consent
To help practitioners and estate representatives submit complete and accurate requests for a waiver of citation and avoid unnecessary delays, the Tax Department refreshed Form AU-67, Instructions for requesting a Waiver of Citation and Consent from the Tax Department. The instruction addresses some common issues:

  • presented in chart format the forms and supplemental documents required for each proceeding, so you may ensure your submissions are complete;
  • added the address for private delivery;
  • provided a general turnaround time; and
  • included filing tips and suggestions (what to send, what not to send).
